TERMS & CONDITIONS

By placing a booking with Hired By H ("Hired By H", "we", "our", or "us"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions. These Terms constitute a legally binding rental agreement between you ("the Client", "you", or "your") and Hired By H.

Hired By H reserves the right to amend, modify or update these Terms & Conditions at any time. The version published on our website at the time your booking is confirmed and will apply to your rental.

By completing your booking, making payment, collecting, receiving or wearing a garment supplied by Hired By H you agree to comply with these Terms & Conditions in full.

1. General Terms

All garments, garment bags, hangers, dust bags, accessories and any accompanying items supplied by Hired By H remain the exclusive property of Hired By H at all times.

Payment of a hire fee grants the Client temporary use of the garment for the agreed rental period only. Under no circumstances does payment of any hire fee, cleaning fee, repair cost, replacement fee or any other payment transfer ownership of any garment or accessory to the Client.

Bookings are not confirmed until full payment has been successfully received by Hired By H.

Hired By H reserves the right to refuse, decline, suspend or cancel any booking before or during the rental period where we reasonably believe there is a risk to our garments, our business, our staff, or where these Terms & Conditions have been breached.

Garments hired from Hired By H may only be worn by the individual named on the booking unless prior written approval has been provided by Hired By H.

Hired By H reserves the right to request valid government-issued photo identification before releasing any garment. Failure to provide satisfactory identification may result in cancellation of the booking without refund where permitted by law.

All prices, hire fees, promotions, discounts and availability are subject to change until full payment has been received.

2. BOOKINGS & PAYMENT

Full payment is required at the time of booking to secure your selected rental dates.

Accepted payment methods include credit or debit card, Apple Pay, Google Pay, Afterpay, bank transfer and cash where approved by Hired By H.

Bookings cannot be held without payment and unpaid bookings may be released without notice.

Unless otherwise required under Australian Consumer Law, all payments made to Hired By H are non-refundable.

Store credit may be issued at the sole discretion of Hired By H in exceptional circumstances. Any approved store credit will remain valid for six (6) months from the date of issue and cannot be extended, transferred or redeemed for cash.

It remains the Client's responsibility to carefully review all sizing information, product descriptions and rental dates before completing a booking.

Incorrect sizing, change of mind, deciding not to wear the garment, event cancellations or personal circumstances do not entitle the Client to a refund.

3. TRY-ON APPOINTMENTS

Try-on appointments are available strictly by appointment only and are approximately twenty-five (25) minutes in duration unless otherwise advised.

Clients are required to arrive on time for their appointment. If you are running late, please notify Hired By H as soon as reasonably possible.

Appointments may be cancelled or rescheduled through the booking confirmation link provided, provided at least six (6) hours' notice is given.

Where applicable, any try-on appointment fee may be deducted from a subsequent rental at Hired By H's discretion.

Hired By H reserves the right to refuse future appointments where repeated cancellations or no-shows occur.

4. RENTAL PERIOD

The rental period commences on the agreed collection or delivery date specified within your booking confirmation and concludes on the agreed return date.

Clients must ensure garments are returned by the required deadline to avoid late fees and to ensure availability for subsequent bookings.

Weekend hires must be returned by 12:00pm (midday) on Monday following the event unless otherwise agreed in writing.

Weekday hires must be returned by 3:00pm on the following business day unless otherwise agreed.

Failure to return a garment by the agreed deadline will result in late fees in accordance with these Terms & Conditions.

5. COLLECTION, SHIPPING & DELIVERY

Hired By H offers both local collection and Australia-wide postage, subject to availability.

Shipping charges are payable in addition to the hire fee unless otherwise stated.

All garments are dispatched from Secret Harbour, Western Australia, and every reasonable effort will be made to dispatch bookings within our advertised timeframes.

Delivery services are provided by independent third-party carriers, including Australia Post. Once a parcel has been dispatched, Hired By H cannot guarantee delivery timeframes and accepts no responsibility for delays caused by Australia Post, courier providers, severe weather, floods, bushfires, public holidays, industrial action, transport disruptions, government restrictions or any other circumstances beyond our reasonable control.

Courier delays do not entitle the Client to a refund. Where appropriate, Hired By H may, at its absolute discretion, offer store credit or transfer the booking to another available date.

Clients are solely responsible for ensuring all delivery information supplied during checkout is accurate. Hired By H accepts no responsibility for delays, failed deliveries or lost parcels resulting from incorrect addresses, incorrect contact details or failure to collect a parcel.

If you require your garment earlier due to travel arrangements, accommodation bookings or interstate travel, you must notify Hired By H before placing your booking. While we will endeavour to accommodate such requests, earlier dispatch cannot be guaranteed due to other bookings.

6. OPTIONAL DAMAGE WAIVER

To provide additional peace of mind, Hired By H offers an optional Damage Waiver for selected bookings. The Damage Waiver is available as an add-on during the booking process and is entirely optional.

Where purchased, the Damage Waiver provides cover for accidental damage to the hired garment of up to AUD $150.00. The Damage Waiver applies only to accidental damage that occurs during normal wear and is accepted by Hired By H following inspection of the returned garment.

The Damage Waiver does not cover loss, theft, failure to return the garment, deliberate or malicious damage, permanent staining caused by negligence, burns, unauthorised alterations, misuse of the garment, damage caused by failure to follow these Terms & Conditions, or any damage exceeding the maximum cover amount.

Where the cost of repairing or replacing a garment exceeds the $150.00 Damage Waiver limit, the Client agrees to pay the remaining balance together with any other reasonable costs incurred by Hired By H.

The Damage Waiver is non-refundable, it is not an insurance policy and does not remove the Client's responsibility to take reasonable care of the garment throughout the rental period.

7. RETURNS

All garments must be returned by the return deadline specified within your booking confirmation unless otherwise agreed in writing by Hired By H.

Weekend rentals must be returned by 12:00pm (midday) on the first business day (Monday) following your event.

Weekday rentals must be returned by 3:00pm on the following business day.

All garments must be returned together with any garment bags, hangers, dust bags, straps or accessories supplied with your booking.

Failure to return any accompanying items will incur a $10 replacement fee per item.

The Client remains responsible for the garment until it has been received, inspected and accepted by Hired By H.

8. POSTAL RETURNS

For postal bookings, garments must be returned over the counter at an Australia Post Office or by another return method approved in writing by Hired By H.

Garments must not be placed into public street posting boxes unless prior written approval has been provided by Hired By H.

Postal returns must be lodged by 2:00pm the next business day or if weekend, the Monday following your event unless otherwise agreed.

Proof of lodgement, including a valid tracking receipt, must be provided to Hired By H immediately after posting.

Failure to lodge the garment by the required time, provide proof of postage or use the approved return method may result in a late fee of AUD $30.00 per day until the garment has been correctly returned.

Where the supplied return satchel has been lost or damaged, the Client must contact Hired By H before returning the garment. Any replacement satchel or additional postage costs will be payable by the Client.

9. LATE RETURNS

Time is critical within a garment rental business. Late returns may prevent another client from receiving their booking and may result in financial loss to Hired By H.

Failure to return a garment by the agreed return deadline will incur a late fee of AUD $30.00 per garment, per day until the garment has been returned and scanned by Australia Post or physically received by Hired By H.

Late fees apply regardless of whether the garment has been worn after the event.

Where a late return impacts another customer's booking, Hired By H reserves the right to recover any reasonable losses incurred, including but not limited to lost rental income, express postage costs, compensation paid to another client, administrative expenses and additional cleaning or preparation costs.

Repeated late returns or repeated breaches of these Terms & Conditions may result in Hired By H refusing future bookings.

10. FAILURE TO RETURN A GARMENT

Failure to return a garment without prior written approval from Hired By H may be treated as the unlawful retention of Hired By H property.

Where a garment has not been returned within seven (7) days of the agreed return date and reasonable attempts to recover the garment have been unsuccessful, Hired By H reserves the right to charge the Client the full Recommended Retail Price (RRP) or replacement value of the garment together with any outstanding late fees, cleaning charges, postage costs, administrative expenses and recovery costs.

Hired By H may engage a debt collection agency, commence legal proceedings or report suspected fraudulent activity to the relevant authorities where permitted by law.

Payment of the replacement value of a garment does not transfer ownership of that garment. All garments remain the exclusive property of Hired By H at all times.

The Client remains liable for all outstanding fees and associated costs until the matter has been resolved in full.

11. GARMENT CARE

All garments supplied by Hired By H are professionally cleaned, inspected and prepared before every hire.

The Client agrees to exercise reasonable care while wearing the garment and to take all reasonable steps to prevent unnecessary damage.

Clients must avoid exposing garments to fake tan, heavy makeup, body oils, perfumes, cigarette smoke, vaping devices, food, wine, coloured beverages, rough surfaces, sharp jewellery, handbags, belts, pets or any substance or object likely to stain, mark or damage the garment.

Only body adhesive approved by Hired By H should be used. Fashion tape, lash glue, fabric glue and other adhesives may permanently damage delicate fabrics and should not be used unless prior approval has been obtained.

The Client must not wash, dry clean, bleach, soak, iron, steam (unless instructed by Hired By H), alter, repair, pin, cut or otherwise modify any garment.

If any staining, damage or fault occurs during the rental period, the Client must notify Hired By H immediately. Attempting to repair or clean the garment without approval may result in additional charges if further damage occurs.

Garments must not be loaned, sub-hired or worn by any person other than the Client named on the booking unless written approval has been provided by Hired By H.

12. CLEANING

Standard professional cleaning is included within the rental fee for normal wear.

Where a garment is returned with excessive staining, excessive odours or soiling beyond what would reasonably be expected from normal wear, Hired By H reserves the right to charge an additional specialist cleaning fee.

Examples include, but are not limited to, fake tan, makeup, food, alcohol, mud, grass, body oils, smoke odours, nail polish, glue, wax or any other contamination requiring specialist treatment.

A minimum specialist cleaning fee of AUD $30.00 per garment applies. Where specialist cleaning exceeds this amount, the Client agrees to pay the full cost incurred by Hired By H.

Cleaning fees are separate from any repair or replacement costs that may also apply.

13. DAMAGE, REPAIRS & REPLACEMENT COSTS

The Client agrees to return every garment in the same condition in which it was received, allowing only for reasonable wear associated with careful use.

Hired By H acknowledges that all garments are professionally maintained rental items and may display minor signs of wear consistent with previous hires. Minor imperfections such as loose threads, minor fabric wear or general wear consistent with careful use will not attract additional charges.

Where a Damage Waiver has been purchased, Hired By H will first assess whether the damage is covered under the terms of the Damage Waiver. Where the damage falls outside the scope of the Damage Waiver or exceeds the maximum cover amount of AUD $150.00, the Client remains responsible for all additional costs payable under these Terms & Conditions.

Chargeable damage includes, but is not limited to, permanent staining, burns caused by hair tools, cigarette or vape burns, fake tan staining, makeup staining, wine or food stains, broken zips, broken straps, torn seams, ripped fabric, missing embellishments, missing buttons, pet damage, glue residue, fabric pulls, holes, excessive wrinkling caused by misuse or any other damage affecting the presentation or future hireability of the garment.

Where damage is considered repairable, the Client agrees to pay the full repair cost as determined by Hired By H's professional seamstress or repair specialist.

Where a garment is permanently stained, destroyed, lost or deemed beyond economical repair, the Client will be liable for the full Recommended Retail Price (RRP) or replacement value of the garment.

Replacement costs must be paid within seven (7) days of notification unless otherwise agreed in writing.

Hired By H reserves the right to inspect and photograph every garment before dispatch or collection and again upon return. These records may be relied upon when assessing the condition of a returned garment or determining responsibility for damage.

Any garment found to have been deliberately damaged, maliciously altered or intentionally misused may result in the immediate cancellation of future bookings and further legal action where appropriate.

14. CONDITION OF GARMENTS UPON COLLECTION OR DELIVERY

All garments supplied by Hired By H are professionally cleaned, inspected and quality checked before every hire.

The Client acknowledges that all garments are pre-loved rental items and may display minor signs of wear consistent with normal rental use. Any significant imperfections known to Hired By H that may materially affect the appearance of a garment will, where reasonably practicable, be disclosed prior to the booking.

Upon receiving the garment, the Client is responsible for inspecting it immediately.

If the Client believes a garment has arrived with undisclosed damage, staining or another significant issue, Hired By H must be notified within six (6) hours of collection or confirmed delivery. Clear photographic evidence must be provided before the garment is worn.

Failure to notify Hired By H within the required timeframe or wearing the garment before reporting the issue may result in the claim being declined.

Where a genuine issue is confirmed, Hired By H may, at its discretion, offer a replacement garment (subject to availability), store credit, a partial refund or a full refund where required under Australian Consumer Law.

15. SIZING

Sizing varies between designers, brands and individual garment styles.

All sizing information, measurements and fit recommendations provided by Hired By H are intended as a guide only and cannot guarantee a perfect fit.

It is the Client's responsibility to review garment measurements, product descriptions, photographs and sizing information before placing a booking.

Hired By H is happy to provide sizing advice where possible; however, the final sizing decision remains the responsibility of the Client.

Refunds, store credit or compensation will not be provided where a garment does not fit, is uncomfortable, is unsuitable for the Client's body shape or is ultimately not worn.

16. CANCELLATIONS, REFUNDS & STORE CREDIT

As each booking reserves a garment exclusively for the selected dates, all payments made to Hired By H are generally non-refundable.

Refunds will not be provided for change of mind, incorrect sizing, choosing not to wear the garment, personal circumstances, event cancellations outside of Hired By H's control or courier delays occurring after dispatch.

Where a booking is cancelled prior to dispatch, Hired By H may, at its sole discretion, issue store credit instead of a refund.

Approved store credit is valid for six (6) months from the date of issue and is non-transferable, non-refundable and cannot be exchanged for cash.

Where Hired By H is unable to fulfil a confirmed booking due to circumstances within our reasonable control and no suitable replacement garment can be provided, Hirebyh may offer a full refund or store credit.

Nothing within this clause limits any rights the Client may have under the Australian Consumer Law.

17. COURIER DELAYS

Hired By H dispatches all garments within the advertised timeframes and takes reasonable care to ensure orders are sent promptly.

Once a parcel has been collected by Australia Post or another approved courier, delivery is outside the control of Hired By H.

Hired By H  is not responsible for delays caused by Australia Post, courier providers, severe weather, floods, bushfires, public holidays, transport disruptions, industrial action, government restrictions or any other event beyond our reasonable control.

Courier delays do not entitle the Client to compensation, reimbursement or a refund.

Where appropriate, Hirebyh may, at its absolute discretion, offer store credit or transfer the booking to another available date.

18. PHOTOGRAPHY & SOCIAL MEDIA

We love seeing our clients wearing Hired By H garments.

By tagging Hired By H on social media, sending us photographs or videos, or otherwise providing content featuring our garments, the Client grants Hired By H a non-exclusive, royalty-free licence to repost, publish and share that content across our website, social media platforms, email marketing and promotional material.

The Client retains ownership of all original content.

If the Client does not wish for their content to be shared by Hired By H they must notify us in writing before publication.

19. CHARGEBACKS, PAYMENT DISPUTES & FRAUD

By placing a booking, the Client agrees not to initiate a chargeback or payment dispute where Hired By H has fulfilled its obligations under these Terms & Conditions.

If an issue arises with a booking, the Client agrees to contact Hired By H first to allow a reasonable opportunity to resolve the matter.

Where a chargeback or payment dispute is initiated fraudulently, dishonestly or without reasonable grounds, Hired By H reserves the right to recover all outstanding rental fees, chargeback fees, administrative expenses, debt recovery costs and legal costs where permitted by law.

Providing false information, using another person's payment method without authorisation, supplying false identification or attempting to obtain a garment through deception constitutes a serious breach of these Terms & Conditions and may result in cancellation of the booking, refusal of future bookings and referral to the appropriate authorities.

20. PRIVACY & IDENTIFICATION

Hired By H respects your privacy and is committed to protecting your personal information.

Personal information collected during the booking process is used solely for processing bookings, communicating with Clients, verifying identity where necessary, preventing fraud and complying with applicable legal obligations.

Hired By H reserves the right to request valid government-issued identification before releasing a garment.

Failure to provide requested identification or providing false or misleading information may result in cancellation of the booking.

Hired By H will handle all personal information in accordance with the Privacy Act 1988 (Cth) and any other applicable Australian privacy legislation.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Hired By H will not be liable for any indirect, incidental, consequential or special loss arising from or in connection with a booking or garment rental.

This includes, but is not limited to, courier delays, missed events, accommodation costs, travel expenses, photography costs, makeup or hair appointments, emotional distress, loss of income or any costs arising from circumstances beyond the reasonable control of Hired By H.

Nothing within these Terms excludes or limits any rights that cannot legally be excluded under the Australian Consumer Law.

Where liability cannot be excluded, Hired By H's liability is limited to the remedies available under Australian Consumer Law.

23. AUSTRALIAN CONSUMER LAW

Nothing contained within these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where any provision of these Terms is found to be inconsistent with Australian Consumer Law, the relevant provisions of the legislation will prevail to the extent of the inconsistency.

24. GOVERNING LAW

These Terms & Conditions are governed by the laws of Western Australia.

Any dispute arising from these Terms & Conditions or any booking with Hired By H will be subject to the exclusive jurisdiction of the courts of Western Australia and any Australian court hearing appeals from those courts.

25. SEVERABILITY

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be severed from the remaining Terms, which will continue in full force and effect.

Failure by Hired By H to enforce any right under these Terms does not constitute a waiver of that right.

26. ENTIRE AGREEMENT

These Terms & Conditions constitute the entire agreement between the Client and Hired By H in relation to the rental of garments and supersede any previous discussions, representations or agreements.

By completing a booking, making payment, collecting, receiving or wearing a garment supplied by Hired BY H the Client confirms that they have read, understood and agreed to be legally bound by these Terms & Conditions.

Electronic acceptance of these Terms during checkout has the same legal effect as a handwritten signature and forms a legally binding agreement between the Client and Hired By H.
